Terms and Conditions

This Statement outlines the terms and conditions governing all sales and purchases made through this website, regardless of whether the order was transmitted via the internet, telephone/fax or post. By accessing, browsing and/or using this site you acknowledge that you have read, understood and agree to be bound by these terms and to comply with all applicable laws and regulations.

Please read these terms carefully. We may modify these terms and conditions and change any content of this website at any time. These terms and conditions are governed by and will be interpreted in accordance with the law of New Zealand and any disputes relating to these terms and conditions will be subject to the non-exclusive jurisdiction of the Courts of New Zealand.

ACCOUNTS

  • Any Supply Point account is to be used only by the person registered for that particular account. All information provided on registration must be true and accurate. False information provided on registration is considered fraud.
  • The account holder is responsible for ensuring that their account details remain confidential, and that access to their computer remains restricted to prevent others from gaining access to their account. The account holder accepts responsibility for all activities which occur under their account. Supply Point reserves the right to refuse service, terminate accounts, or cancel orders at any time and will not be held responsible for fraudulent information

PRIVACY

Your personal information is important to us. We recognise that your privacy is very important to you as such your information will not be given or sold to any outside organisation for marketing purposes without your consent.

PRICING

All prices quoted excl  GST and are subject to change at any time from Suppliers and Supply Point. Supply Point reserves the right to reject any orders which include incorrect prices which may occur due to data entry errors, code errors, etc.

DISCLAIMER

  • Your use of the information and data contained on this web site is at your sole risk. In no event shall Supply Point and/or its parent company or suppliers be liable for any loss or damage arising out of the use of any of the information supplied herein, whether such loss or damage arises directly.
  • The Purchaser acknowledges that no warranty or condition expressed or implied is given by Supply Point or its parent company, as to the condition of the goods or as to the suitability or fitness of the goods for any purpose  and that the seller and supplier is not responsible or liable in any way for adverse consequences of any nature whatsoever that may arise from the use of goods by the purchaser.
  • The Seller shall be under no liability whatsoever to the Buyer for any indirect loss and/or expense (including loss of profit) suffered by the Buyer arising out of a breach by the Seller of these terms and conditions.

DELIVERY

  • Delivery of the Goods shall be made to the Buyer’s nominated address. The Buyer shall make all arrangements necessary to take delivery of the Goods.
  • Delivery of the Goods to a third party nominated by the Buyer is deemed to be delivery to the Buyer for the purposes of this agreement (including Transport yard or construction site.)
  • The Seller may deliver the Goods by separate installments (in accordance with the agreed delivery schedule). Each separate installment shall be invoiced and paid for.
  • The Seller shall not be liable for any loss or damage whatsoever due to failure by the Seller to deliver the Goods (or any of them) promptly or at any later time.

OWNERSHIP

  • Title in the goods transfers on Payment. Title of the goods shall not be transferred to the customer until all money outstanding is paid in full to the Supply Point and all direct debits and/ or credit card payments have cleared. At all times Supply Point shall be entitled to recover from the customer the value of the goods (as invoiced) as a liquidated sum.
  • Any credit account holder agrees to give Supply Point not less than 14 days prior written notice of any proposed change in the customer’s name and/or any other changes in the customer’s details (including but not limited to, changes in the customer’s address, facsimile number, trading name or business practice.
  • All expenses, costs (including actual legal costs) fees and disbursements incurred by Supply Point (or its parent company)  in recovering the money and any other amounts payable under the Terms shall be recoverable from the Customer.
  • The Customer agrees that it will upon demand by the Company, pay all costs incurred by the Company in registering and maintaining a financing statement (including financing change statements) on the Personal Property Securities Register and/or enforcing or attempting to enforce the security interest created by these conditions of sale including subordination agreements.
  • Unless agreed in writing by the company, payment is to be made in full by the 20th of the month after date of invoice (the due date).
  • Interest may be charged on monies outstanding after the due date at a rate of 15% per annum, until payment of outstanding money is made in full (including all incurred interest charges).

If any provision of these terms and conditions shall be invalid, void or illegal or unenforceable the validity existence, legality and enforceability of the remaining provisions shall not be affected, prejudiced or impaired.

LICENSE AND SITE ACCESS

Access to the Supply Point website is granted only for the purpose of accessing the services provided. Under no circumstances may any individual alter any part of the website or try to access it other than through a web browser for the purposes of obtaining information or purchasing product. No part of this site may be reproduced for any reason, nor may any parts of the site be displayed anywhere else using frames or other html manipulation process unless written permission has been granted by Supply Point. This includes logos, trademarks, or registrations.
